What Will It Really Cost to Keep Fighting?

The parties were far apart. Both were certain they were right. Then we examined one key piece of evidence together. They realized they had understood the same fact differently. Positions softened. The risks became real. The case settled.

That is what effective mediation can do. It changes the question.

Not: “How much can I win?”

But: “What will it cost me to keep fighting?”

That cost is not limited to attorneys’ fees and expert expenses. It includes delay, distraction, stress, reputational risk, uncertainty, and the possibility that even a favorable judgment may be difficult, if not impossible, to collect. It also includes the cost of being wrong.

Litigation consumes time and energy. It can pull business leaders away from running their companies, keep employees focused on the dispute, strain relationships, and prevent individuals from moving forward.

And the longer a case continues, the more difficult it can become to evaluate it clearly. Confidence hardens into commitment. Money already spent starts to feel like a reason to spend more. The case becomes less about the best business decision and more about proving that the decision to keep fighting was justified. That does not mean every case should settle. Some cases need to be tried. Some positions should not be compromised.

But every party should assess the full range of outcomes. The real comparison is not between settlement and victory. It is between settlement and everything that comes with continuing to litigate.

A successful mediation does more than resolve a case. It teaches an important lesson: Settlement offers something litigation cannot guarantee: The ability to move forward.
